Labeling Requirements by State

Below are the labeling requirements for each state in the United States. Most states have similar requirements that are based on FDA regulations. Each baker should review the information for their state, however, as some variances do still exist.

ALABAMA

SAMPLE LABEL

Labeling Requirements for Alabama Cottage Food Bakers

  • Name of the individual or business
  • Physical address or post office box of the individual or business
  • Common name of the food
  • Statement: This product may contain allergens. This food is not inspected by the Health Department.
  • List of ingredients: Ingredients and sub-ingredients must be listed in descending order of predominance by weight.

Must use minimum 10 point font on label

ALASKA

SAMPLE LABEL

Labeling Requirements for Alaska Cottage Food Bakers

  • On a card, placard or sign a statement should be read that “These products are not subject to state inspection”
  • Should be posted or shown in a conspicuous area for consumers to see.
  • Individual’s Alaska business license number or have their name, physical address, and telephone number – this is utilized for traceback purposes. 
  • The label requirement does not apply to sellers who prepared their products in a permitted and approved ADEC kitchen.

ARIZONA

SAMPLE LABEL

Labeling Requirements for Arizona Cottage Food Bakers

  • The name and registration number of the food preparer
  • Registration numbers began July 1, 2019. Home address is no longer required on the label.
  • A list of all the ingredients in the product
  • The product’s production date
  • The following statement: “This product was produced in a home kitchen that may process common food allergens and is not subject to public health inspection.”
  • If applicable, a statement that the product was made in a facility for individuals with developmental disabilities.

ARKANSAS

SAMPLE LABEL

While foods produced under the Food Freedom Act are exempted from ADH labeling requirements, the Act does require certain information to be provided to the informed end consumer by disclosing:

  • The date that the Homemade Non-TCS Food was manufactured, produced, or processed.
  • The name, address, and telephone number of the producer. Producers who do not wish to disclose this information for safety reasons may request an identification number provided by the Arkansas Department of Agriculture to be used instead of this information. (To obtain an ID number, please fill out this form from the Arkansas Department of Agriculture.)
  • The common or usual name of the food.
  • The ingredients of the food in descending order of predominance.
  • The statement: “This product was produced in a private residence that is exempt from state licensing and inspection. This product may contain allergens.”

CALIFORNIA

SAMPLE LABEL

The common or descriptive name of the CFO food product located on the primary (principal) display panel. 

  • The name, city, and zip code of the CFO operation which produced the cottage food product. If the CFO is not listed in a current telephone directory, then a street address must also be included on the label. 
  • A contact phone number or email address is optional but may be helpful for contact in case a consumer wishes to contact you.
  • The words “Made in a Home Kitchen” or “ Repackaged in a Home Kitchen” as applicable, in 12-point type must appear on the principal display panel. *Note: if labeled as “Repackaged in a Home Kitchen” then a description of any purchased ready-to eat products not used as an ingredient must also be included on the label. 
  • The registration or permit number of the CFO which produced the cottage food product and the name of the county of the local enforcement agency that issued the permit number. 
  • The ingredients of the cottage food product, in descending order of predominance by weight, if the product contains two or more ingredients. The net quantity (count, weight, or volume) of the food product, stated in both English (pound) units and metric units (grams). 
  • A declaration on the label in plain language if the food contains any of the major food allergens such as milk, eggs, fish, shellfish, tree nuts, wheat, peanuts, and soybeans. There are two approved methods prescribed by federal law for declaring the food sources of allergens in packaged foods: a) in a separate summary statement immediately following or adjacent to the ingredient list, or b) within the ingredient list.

COLORADO

SAMPLE LABEL

All Cottage Foods should be packaged and labeled with specific information including an exact disclaimer prior to selling them directly to the informed consumer. All Cottage Food products must be labeled with a disclaimer stating that they were produced in a home kitchen without regulatory oversight and may also contain common allergens. Cottage Foods labeled as “organic” have to be certified by a United States Department of Agriculture (USDA) – National Organic Program accredited certification agency. A producer may list an ingredient as “organic” without obtaining certification as long as the term “organic” is not on the primary label.

CONNECTICUT

SAMPLE LABEL

All products are required to be labeled.

  • Name and address of the cottage food operation.
    Name of the cottage food product (All capital letters or upper/lower
    case are both acceptable).
  • The ingredients in the cottage food product in descending order
    of predominance by weight.
  • If you use a prepared item in your recipe, you must list the sub
    ingredients as well. For example: “soy sauce” is not acceptable,
    but “soy sauce (wheat, soybeans, salt)” would be acceptable.
    The net weight or net volume of the cottage food product (this
    must also include the metric equivalent; conversion charts are
    available online).
  • Allergen labeling as specified in federal labeling requirements.
    The following statement must be printed in at least ten-point
    type in a clear and conspicuous manner: “Made in a Cottage
    Food Operation that is not Subject to Routine Government Food
    Safety Inspection.”

DELAWARE

SAMPLE LABEL

Products shall be properly labeled with the following: 

  • Name of CFE, name of product, name, address, phone number and email of CFE, net weight or unit count, date of production / lot number.
  • Labels shall include a list of ingredients in decreasing order by weight. If the product label is too small to allow for printing of ingredients, the list shall be available at the request of the consumer.
  • Labels shall include the name of the food source for each major food allergen contained in the food unless the food source is already part of the common or usual name of the respective ingredient.
  • Labels shall include the following statement: “This food is made in a Cottage Food Establishment and is NOT subject to routine Government Food Safety Inspections”.
  • Labels shall be printed in at least 10-point type in a color that provides a clear contrast to the background label.

DISTRICT OF COLUMBIA

SAMPLE LABEL

Label must include the following:

  • Cottage food business identification number
  • Name of the cottage food product
  • Ingredients of the cottage food product in descending order or amount of each ingredient by weight
  • Net weight or net volume of the cottage food product
  • Allergen information as specified by federal labeling requirements in 21 CFR Section 101, Food Labeling, if the cottage food product is made from foods including but not limited to: eggs, milk, wheat, peanuts, tree nuts (such as pecans, almonds, cashews, pistachios, and walnuts), soybeans, fish (such as bass, flounder, cod), and crustacean shellfish (such as crabs, shrimp, and
    lobsters)
  • If any nutritional claim is made, nutritional information as specified by federal labeling requirements in 21 CFR Part 101, Food Labeling and 9 CFR Part 317, Subpart B, Nutrition Labeling
  • A statement printed in 10-point font or larger type with in a color that provides clear contrast to the background of the label that reads:
    Made by a cottage food business that is not subject to the District of Columbia’s food safety regulations.

FLORIDA

SAMPLE LABEL

A cottage food operation may only sell cottage food products which are prepackaged with a label affixed that contains the following information (printed in English):

  • The name and address of the cottage food operation;
    The name of the cottage food product;
  • The ingredients of the cottage food product in descending order of
    predominance by weight;
  • The net weight or net volume of the cottage food product;
  • Allergen information as specified by federal labeling requirements;
  • If any nutritional claim is made, appropriate nutritional information as specified by federal labeling requirements; and
  • The following statement printed in at least 10-point type in a color that provides a clear contrast to the background label: “Made in a cottage food operation that is not subject to Florida’s food safety regulations”

GEORGIA

SAMPLE LABEL

Labeling is required for Cottage Food Products, and the method will vary depending on the manner of sale:

Direct sale. For cottage food products that are custom sold to an individual consumer (ex. wedding cakes, birthday cakes, etc.) the following information must be on the package:

  • The business name and home address of the cottage food operator;
  • The following statement must be conspicuously labeled on the package, “MADE IN A COTTAGE FOOD OPERATION THAT IS NOT SUBJECT TO STATE FOOD SAFETY INSPECTIONS.” This statement must appear in Times New Roman or Arial font, in at least 10-point type; and in a color that contrasts to the background color of the label.

Pre-Packaged foods. Cottage food products individually packaged, wrapped, or otherwise containerized for sale to the end consumer must have a product label attached to the package. The following information must be included on the label:

  • The business name and home address of the cottage food operator;
  • The common name of the cottage food product;
  • The ingredients in descending order of predominance by weight;
  • The net weight or volume of the product;
  • Allergen labeling as specified by FDA labeling requirements;
  • If a nutritional claim is made, appropriate nutritional information as specified by FDA labeling requirements;
  • The cottage food statement as described above.

HAWAII

SAMPLE LABEL

All HMF products require specific labeling with the following information:


1. A statement that reads “Made in a home kitchen not routinely inspected
by the Department of Health”.
2. Common name of the product or descriptive name.
3. Ingredient list if made from 2+ ingredients, listed in descending order of
predominance by weight.
4. Name and contact information of the homemade food product operator

IDAHO

SAMPLE LABEL

Foods that you produce in your home need to be clearly labeled on the product packaging; or by a clearly visible placard at the sales/service location that also states: The food was prepared in a home kitchen that is not subject to regulation and inspection by the regulatory authority; and The food may contain allergens.

ILLINOIS

SAMPLE LABEL

The label must include the following:

  • The name of the cottage food operation and unit of local government (county,  township, city, or village ) in which the cottage food operation is located.
  • The identifying registration number provided by the local health department on the certificate of registration and the name of the municipality or county in which the registration was filed.
  • The common or usual name of the food product.All ingredients of the food product, including any color, artificial flavor, and preservative, listed in descending order by predominance of weight shown with the common or usual names.
  • The following phrase in prominent lettering: “This product was produced in a home kitchen not inspected by a health department that may also process common food allergens. If you have safety concerns, contact your local health department.”
  • The date the product was processed or prepared.
  • Allergen labeling as specified under federal labeling requirements.

INDIANA

SAMPLE LABEL

HBV food products must be labeled according to IC 16-42-5-29(c)(5)


– Producer’s name and address
– Common or usual name of food product
– Ingredients of food product
– Net weight and volume or numerical count
– Date food product was processed
– The following statement in 10 point type: “This product is home
produced and processed and the production area has not been
inspected by the State Department of Health.”

IOWA

SAMPLE LABEL

Cottage food labels MUST contain the following information:

  1. Information to identify the name and address, phone number, or email address of the person preparing the food;
  2. The common name of the food;
  3. The ingredients of the cottage food in descending order of predominance;
  4. The following statement: “This product was produced at a residential property that is exempt from state licensing and inspection.”;
  5. If the cottage food contains one or more major food allergens, an additional allergen statement must be included on the label identifying each major allergen contained in the food by the common name of the allergen; and
  6. If the food is home-processed and home-canned pickles, vegetables, or fruits permitted under this section, the date that the food was processed and canned.

KANSAS

SAMPLE LABEL

Kansas does not currently require labeling on cottage food products though it is always a good idea to include the following:

  1. Information to identify the name and address, phone number, or email address of the person preparing the food;
  2. The common name of the food;
  3. The ingredients of the cottage food in descending order of predominance;
  4. The following statement: “This product was produced at a residential property that is exempt from state licensing and inspection.”;
  5. If the cottage food contains one or more major food allergens, an additional allergen statement must be included on the label identifying each major allergen contained in the food by the common name of the allergen

KENTUCKY

SAMPLE LABEL

Cottage food labels MUST contain the following information:

  1. The common or usual name of the food product.
  2. The name and address of the home-based processing operation, including the street address, city, state, and zip code.
  3. The ingredients of the food product. Ingredients shall be in descending order of predominance by weight.
  4. The net weight or volume of the food product by standard measure or numerical count.
  5. The following statement in 10-point type: “This product is home-produced and processed.”
  6. The date the product was processed.
  7. Allergen identification for all ingredients that contain any of the Major Food Allergens known as The Big 8 Allergens: milk, eggs, wheat, soybean (soy), peanuts, tree nuts, fish and shellfish.

LOUISIANA

SAMPLE LABEL

Cottage food labels MUST contain the following information:

– Producer’s name and address
– Common or usual name of food product
– Ingredients of food product
– Net weight and volume or numerical count
– Date food product was processed
– The following statement in 10 point type: “This product was produced in a cottage kitchen and not a licensed or regulated facility”.

MAINE

SAMPLE LABEL

Maine does not currently require labeling on cottage food products though it is always a good idea to include the following:

  1. Information to identify the name and address, phone number, or email address of the person preparing the food;
  2. The common name of the food;
  3. The ingredients of the cottage food in descending order of predominance;
  4. The following statement: “This product was produced at a residential property that is exempt from state licensing and inspection.”;
  5. If the cottage food contains one or more major food allergens, an additional allergen statement must be included on the label identifying each major allergen contained in the food by the common name of the allergen.

MARYLAND

SAMPLE LABEL

Cottage food labels MUST contain the following information:

  • The name and address of the cottage food business;
  • The name of the cottage food product;
  • The ingredients (and sub-ingredients) of the cottage food product in descending order of
  • the amount of each ingredient by weight;
  • The net weight, count, or net volume of the cottage food product;
  • Allergen information as specified by federal labeling requirements;
  • Nutritional information as specified by federal labeling requirements, if any health or nutritional information claim is made; and
  • Printed in 10 point or larger type in a color that provides a clear contrast to the background of the label: “Made by a cottage food business that is not subject to Maryland’s food safety regulations.”

For cottage food products sold at retail stores, labels must additionally include:

  • The phone number and e–mail address of the cottage food business; and
  • The date the product was made.

MASSACHUSETTS

SAMPLE LABEL

Cottage food labels MUST contain the following information:

  1. The name and address of the Cottage Food Operation;
  2. The name of the Cottage Food Product;
  3. The ingredients of the Cottage Food Product, in descending order of predominance by weight;
  4. The net weight or net volume of the Cottage Food Product;
  5. Allergen information as specified by federal labeling requirements. This includes identifying if any of the ingredients are made from one of the following food groups: milk, eggs, wheat, peanuts, soybeans, fish (including shellfish, crab, lobster or shrimp) and tree nuts (such as almonds, pecans or walnuts); AND
  6. Nutritional labeling as specified by federal labeling requirements is required if any nutrient content claim, health claim, or other nutritional information is provided. 

MICHIGAN

SAMPLE LABEL

The basic information that must be on the label is as follows:

  • Name and physical address of the Cottage Food operation (You must use the physical address of your home kitchen; Post Office Box addresses are not adequate).
  • Name of the Cottage Food product (All capital letters or upper/lower case are both acceptable).
  • The ingredients of the Cottage Food product, in descending order of predominance by weight. If you use a prepared item in your recipe, you must list the sub ingredients as well. For example: soy sauce is not acceptable, soy sauce (wheat, soybeans, salt) would be acceptable, please see the label below for further examples.
  • The net weight or net volume of the Cottage Food product (must also include the metric equivalent – conversion charts are available online).
  • Allergen labeling as specified in federal labeling requirements.
  • The following statement: “Made in a home kitchen that has not been inspected by the Michigan Department of Agriculture & Rural Development” in at least the equivalent of 11-point font (about 1/8″ tall) and in a color that provides a clear contrast to the background (All capital letters or upper/lower case are both acceptable).

MINNESOTA

SAMPLE LABEL

The basic information that must be on the label is as follows:

  • Your full name as the individual cottage food registrant OR your cottage food business name submitted on your cottage food application (if operating as a DBA or other legal Minnesota business entity),
  • Your registration number OR address submitted on the cottage food application,
  • The date that the food was made,
  • The statement “these products are homemade and not subject to state inspection”, and
  • A list of ingredients contained in the product, including any allergens. The allergens of concern are milk, eggs, wheat, soy, peanuts, tree nuts, fish, shellfish, and sesame*. 

MISSISSIPPI

SAMPLE LABEL

Mississippi law and regulations require seven components on cottage food labels:

  1. The name and address of the cottage food operation.
  2. The name of the cottage food product.
  3. The ingredients of the cottage food product, in descending order of predominance by weight.
  4. Allergen information as specified by federal labeling requirements.
  5. The net weight or volume of the cottage food product.
  6. If any nutritional claim is made, appropriate nutritional information as specified by federal labeling requirements.
  7. The following statement printed in at least 10-point type in a color that provides a clear contrast to the background of the label: Made in a cottage food operation that is not subject to Mississippi’s food safety regulations.

MISSOURI

SAMPLE LABEL

The basic information that must be on the label is as follows:

  • the name and address of the manufacturer/processor preparing the food,
  • common name of the food,
  • name of all the ingredients in the food in order of predominance,
  • the net weight of the food in English or metric units,
  • and a statement that the product is prepared in a kitchen that is not subject to inspection by the department.
  • It is recommended that honey manufacturers/processors include this additional statement to their product label: “Honey is not recommended for infants less than twelve (12) months of age.

MONTANA

SAMPLE LABEL

The basic information that must be on the label is as follows:

  • the name and address of the manufacturer/processor preparing the food,
  • common name of the food,
  • name of all the ingredients in the food in order of predominance,
  • the net weight of the food in English or metric units,
  • and a statement that the product is prepared in a kitchen that is not subject to retail food establishment regulations or inspections.

NEBRASKA

SAMPLE LABEL

The basic information that must be on the label is as follows:

  • Label must be legible and in English
  • Label must include:
    • The common name of the food
    • The name and address of the cottage food operator
    • The name of all the ingredients in the food in descending order of predominance by weight
    • The net weight or net volume of the food
    • The following statement: “The food was prepared in a kitchen that is not subject to regulation and inspection by the regulatory authority and may contain allergens.”

NEVADA

SAMPLE LABEL

The basic information that must be on the label is as follows AND must be in a minimum 10 point font:

  • Statement of identity – the common, usual name or descriptive identity of the packaged food item
  • Net quantity of contents – net weight in ounces, pounds, or grams, or net content in fluid ounces pints or liters, or number of pieces
  • Ingredient statement – a list of all ingredients, in descending order of predominance by weight. This includes listing all ingredients of an ingredient that in itself contains two or more ingredients
  • The name and physical address where the product was manufactured, packaged or distributed
  • Declaration of any food allergen contained in the food, unless the food source is already part of the common or usual name of the product or clearly identified in the ingredient list
  • Major food allergens include milk, eggs, fish, crustacean or bivalve shellfish, tree nuts, wheat, peanuts and soybeans and any ingredient that contains protein derived from any one of these ingredients or additives

Allergen information must be included in one of two ways:

  •  In parentheses following the name of the ingredient, for example: lecithin (soy), flour (wheat), and whey (milk); or
  • Immediately after or next to the list of ingredients in a “contains” statement. Example: Contains wheat, milk and soy

NEW HAMPSHIRE

SAMPLE LABEL

The basic information that must be on the label is as follows:

  • Name
  • Address
  • Phone number of the homestead food operation
  • Name of the homestead food product
  • The ingredients of the homestead product, in descending order of predominance by weight,
  • The name of each major food allergen contained in the food unless it is already part of the
  • common or usual name of the respective ingredient already disclosed in the ingredient statement.
  • For exempt Homestead Food Products, the label must also state in at least 10pt font: “This product is exempt from New Hampshire licensing and inspection.”
  • For non-exempt Homestead Food Products, the label must also state in at least 10pt font: “This product is made in a residential kitchen licensed by NH DHHS.”
  • Hand-printed labels are acceptable if they are clearly legible, written with durable, permanent ink, and printed large enough to equal the font size requirements listed above.

NEW JERSEY

SAMPLE LABEL

A cottage food operator shall affix one or more labels or tags on cottage food that collectively state at least the following:

  • The common name of the cottage food product;
  • The cottage food product ingredients in descending order of predominance by weight;
  • If the cottage food product contains a major food allergen, the word, “Contains” followed by a list of the major food allergens that the cottage food product contains;
  • The cottage food operator’s name, business name, and Cottage Food Operator Permit number;
  • The name of the municipality in which the cottage food operator prepares the cottage food product, which shall be the same as the municipality that appears of record with the Department as the cottage food operator’s residence, followed by either “New Jersey” or “NJ”; and
  • The statement, “This food is prepared pursuant to N.J.A.C. 8:24-11 in a home kitchen that has not been inspected by the Department of Health.”

NEW MEXICO

SAMPLE LABEL

The following is required on labels/place cards:

  • The name, home address, telephone number and email address of the processor of the food item.
  • The common or usual name of the food item (i.e. Chocolate Chip Cookies)
  • The ingredients of the food item listed from most to least present in the item.
  • All sub-ingredients must be included on the ingredients statement. For example, when including “butter” on the ingredients statement, you must include all ingredients listed on the butter package like this: “butter (cream (milk), salt)”.
  • The following statement must be on the label: “This product is home produced and is exempt from state licensing and inspection. This product may contain allergens.”

NEW YORK

SAMPLE LABEL

Product labels are required to contain the following information: common/usual name of the product, ingredient list in predominance by weight, net quantity of contents, processor name, and full address. All allergens (eggs, milk, fish, shellfish, soybeans, peanuts, tree nuts, wheat) must be clearly identified in the product ingredient statement.

We recommend that processors add a phrase like “Made at Home by XYZ,” or “Made in the Home Kitchen of XYZ,” or “Made in a Home Kitchen,” to their label in addition to the label requirements outlined below. The font size for this phrase should be 1/16th inch or larger.

NORTH CAROLINA

SAMPLE LABEL

Any products to be sold to consumers must be packaged to protect them from contamination. A label must be affixed to the package with:

  1. Product name
  2. Manufacturer’s name and physical address. NOTE: The use of a website address cannot be substituted for the required information. Application for Home Food Processor
  3. Net quantity contents of the product in either ounces/pounds and the gram weight equivalent, or fluid ounces and the mL equivalent.
  4. Complete list of ingredients in order of predominance by weight.

NORTH DAKOTA

SAMPLE LABEL

Cottage Food Production Operations must label all of their food products properly, which includes specified information on the label of each unit of food product offered or distributed for sale.

All processed packaged foods bear a label stating the

  • name and address of the manufacturer/processor preparing the food,
  • common name of the food,
  • name of all the ingredients in the food in descending order of predominance by weight.
  • the net weight of the food in English or metric units.
  • Any product created in a kitchen must have a sign or label stating “This product is made in a home kitchen that is not inspected by the state or local health department.”

OHIO

SAMPLE LABEL

The “Cottage Food Production Operation” is required to label all of their food products properly, which include the following information on the label of each unit of food product offered or distributed for sale:

  • Statement of Identity – the name of the food product;
  • Net Quantity of Contents – the net weight, in both U.S. Customary System and International System
  • Ingredient List – ingredients of the food product, listed in descending order of predominance by weight;
  • Statement of Responsibility – the name and address of the business;
  • The following statement in ten-point type: “This Product is Home Produced.”

OKLAHOMA

SAMPLE LABEL

All homemade food must be labelled with the following information:

  • The producer’s name and phone number.
  • The physical address where the food was produced.
  • A description of the food product.
  • The ingredients of the food, in ascending order of proportion.
  • A statement indicating the presence of any of the eight most common allergens (milk, eggs, peanuts, tree nuts, soy, wheat, fish, and shellfish).
  • The statement: “This product was produced in a private residence that is exempt from government licensing and inspection.”

OREGON

SAMPLE LABEL

Any products prepared in an exempt residential kitchen must contain the following statement: “This product is homemade and is not prepared in an inspected food establishment.” The statement must be on the principal display panel.

The principal display label must also include: 

  • The business name, phone number, and home address for the food establishment; 
  • The name of the product; 
  • The ingredients of the product in descending order by weight; 
  • The net weight or net volume of the product; 
  • Any applicable allergen warnings as specified in the Food Allergen Labeling & Consumer Protection Act of 2004 (FALCPA); and 
  • If the label provides any nutrient content claim, health claim, or other nutritional information, add the appropriate product nutritional information as described in Title 21, Part 101 of the Code of Federal Regulations

PENNSYLVANIA

SAMPLE LABEL

The food must be packaged in a manner that prevents product contamination, except for foods that are too large and or bulky for conventional packaging. Food labels should include the following information:

  •  Producer’s name and address
  •  Ingredients of food product
  •  Net weight and volume
  • The common or usual name of the product, if a food is made with a major food allergen, such as eggs, nuts, soy, peanuts, milk or wheat that ingredient must be listed on the label; and
  • The labels must be legible.

RHODE ISLAND

SAMPLE LABEL

The following items are required for each product label.

  • Business name, address, and telephone number;
  • The ingredients of the cottage food product in descending order of predominance by weight or volume (e.g., highest volume or weight ingredient should be listed first);
  • Allergen information, as specified by federal and state labeling requirements. If any of the major allergens are in your product, such as milk, eggs, tree nuts, peanuts, wheat, and soybean, they must be listed on the label; and
  • The following statement printed in at least ten-point type in a clear and conspicuous manner that stands out from the background color or pattern of the label for any food produced in a residential kitchen:

“Made by a Cottage Food Business Registrant That is Not Subject to Routine Government Food Safety Inspection”

SOUTH CAROLINA

SAMPLE LABEL

Labels must include:

  • the name and address of the home-based food production operation, 
  • the product name, 
  • the ingredients in descending order of predominance by weight;

SOUTH DAKOTA

SAMPLE LABEL

Food prepared at a residence may not be sold unless it has a label that includes the following information:

  • Name of the product;
  • Name of the producer;
  • Physical address of production;
  • Mailing address of the producer;
  • Telephone number of the producer;
  • Date the product was made or processed;
  • Ingredients;
  • In the case of food sold in accordance with section 3 of this Act, a directive to keep refrigerated or frozen; and
  • A disclaimer that states: “This product was not produced in a commercial kitchen. It has been home-processed in a kitchen that may also process common food allergens such as tree nuts, peanuts, eggs, soy, wheat, milk, fish, and crustacean shellfish.”

TENNESSEE

SAMPLE LABEL

All homemade food products sold under the cottage food laws must include the following information as directed in the FFA:

1.Producer contact information including:
― Producer’s name
― Home address
― Telephone number

2.Common/usual name of the homemade food product

3.Ingredients of the food item in descending order of predominance by weight

4.The following statement: “This product was produced at a private residence
that is exempt from state licensing and inspection. This product may contain
allergens.”

TEXAS

SAMPLE LABEL

Packaging and labeling requirements for cottage food production operations. All foods prepared by an operator shall be packaged and labeled in a manner that prevents product contamination.

(1) The label information shall include:

(A) the name and physical address of the cottage food production operation;

(B) the common or usual name of the product;

(C) disclosure of any major food allergens, such as eggs, nuts, soy, peanuts, milk, wheat, fish, or shellfish used in the product; and

(D) the following statement: “This food is made in a home kitchen and is not inspected by the Department of State Health Services or a local health department.”

(2) Labels must be legible.

(3) A food item is not required to be packaged if it is too large or bulky for conventional packaging. For these food items, the information required under paragraph (1) of this subsection shall be provided to the consumer on an invoice or receipt.

(4) A label for frozen raw and uncut fruit or vegetables must include the following statement in at least 12-point font when sold: “SAFE HANDLING INSTRUCTIONS: To prevent illness from bacteria, keep this food frozen until preparing for consumption” on the label or on an invoice or receipt provided with the frozen fruit or vegetables.

(5) Advertising media of cottage food products for health, disease, or other claims must be consistent with those claims allowed by the Code of Federal Regulations Title 21, Part 101, Subparts D and E.

NOTE: If your food is a pickled fruit or vegetable, fermented vegetable, or acidified canned plant-based product, then the label also must contain a unique batch number to correspond with your record-keeping.  Read more about pickling, canning, and fermenting.

UTAH

SAMPLE LABEL

Your product label must include:

  •  
  • Statement of Identity (Common or usual name of Product).
  • The net quantity statement
  • The words “Home Produced” in bold and conspicuous 12 point type on the principle display panel.
  • An ingredient statement (unless it is a single ingredient product).
  • The name, street address, city, state, zip code, and telephone number of the cottage
  • Nutrition Statement: Most products must also have a Nutrition Facts statement following the FDA approved format.

VERMONT

SAMPLE LABEL

All processed packaged foods bear a label stating the

  • name and address of the manufacturer/processor preparing the food,
  • common name of the food,
  • name of all the ingredients in the food in descending order of predominance by weight.
  • The food source of major allergens must be listed either adjacent to the ingredients statement.
  • the net weight of the food in English or metric units,.

It is recommended that honey manufacturers/processors include this additional statement to their product label: “Honey is not recommended for infants less than twelve (12) months of age

VIRGINIA

SAMPLE LABEL

Virginia cottage food producers must package their goods with labels displaying:

  • the name,
  • physical address and telephone number of the person preparing the food,
  • and the date the food was processed.
  • Labels also must include the name of the product, net weight, list of ingredients,
  • Labels also must include the statement: “NOT FOR RESALE – PROCESSED AND PREPARED WITHOUT STATE INSPECTION.”

WASHINGTON

SAMPLE LABEL

Products that are produced and sold with the Cottage Food Operation Permit must include the following information on their labels:
• Name of Cottage Food Operation.
• Physical address of Cottage Food Operation.
• Product name.
• Ingredient list, including a break down to the smallest sub-ingredients.
• Identification of any allergens (e.g., wheat, milk, eggs, peanuts, soy, tree nuts, fish, and shellfish).
• Weight or volume in U.S. measures.
• The statement: “Made in a home kitchen that has not been subject to standard inspection criteria.”

WEST VIRGINIA
